... specific company. I’m just making a general statement that we think competition is good. It makes us all better. And we are ready to suit up and go against anyone. However, we will not stand for having our IP ripped off, and we’ll use whatever weapons that we have at our disposal. I don’t know that I could be more clear than that.”

Apple awarded multi-touch patent- end game for everyone else?
jkOnTheRun —
A sharp reader on jkOnTheRun points us to an article discussing the awarding of the multi-touch patent to Apple just a few days ago. This is the patent they filed last year that covers how they have implemented multi-touch on the iPhone and the new MacBooks using the trackpad. The big question with this patent award is if this ends the multi-touch game for everyone else, including the upcoming Palm Pre smartphone. Several netbooks also implement multi-touch using the touchpad and that seems to be in violation of this patent. Apple could license this ...

... In order to prove infringement, the patent owner must establish that the accused infringer practices all of the requirements of at least one of the claims of the patent. The accused infringer has the right to challenge the validity of that patent, something Palm has already suggested it plans to do.
“If faced with legal action,” a Palm spokesperson said last week, “we are confident that we have the tools necessary to defend ourselves.”

Apple Successfully Patents Multitouch, Palm Cringes

... ago, featured some very familiar looking pinching gestures which drew audible swooning from the crowds, but had plenty of folks glancing at their iPhone at the same time. Assuming Apple has an iron grip on the patent and it isn’t disputed or worked around, the best scenario is if Palm forks over licensing fees to Apple so their last ditch at survival isn’t totally snuffed out. To see the specifics of Apple’s patent, hit up the US Patent Office.

Apple’s multi-touch patent sets up a legal battle with Palm
The Apple Core —
... me appreciate (and miss!) having multi-touch on that device. It’s truly a competitive advantage for Apple because it’s so intuitive and natural feeling. Android, on the other hand, is relegated to simple zoom in (+) and zoom out (-) buttons and a goofy loupe interface that allows you to scroll to a specific part of a long Web page. The only thing that I can compare the loupe feature to is reading a newspaper with a magnifying glass. So, will Cook and Co. release the hounds? Tip: World of Apple

... could create below the screen. Seems like Apple locked that up too covering non-visual touchscreen gesture inputs.
This patent isn’t particularly good news for the Pre or for Palm. The businessman in me says Palm considered these pending patents when creating the Pre, so I will hold out hope that they’ve got a work around or enough money in the bank to push off a protracted legal battle until well after it doesn’t matter any more.
